Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (“you”, “your”, “Customer”) and Credtech Solutions (“Credtech”, “we”, “us”) governing your access to and use of Credtech Trigger (the “Service”).

By creating an account, connecting a social platform, or using the Service in any way, you agree to these Terms and our Privacy Policy.

1. The Service

Credtech Trigger is a social-media intelligence platform that ingests public conversation from X (Twitter), Facebook, Instagram, and Threads, and provides analytics including sentiment classification, topic detection, virality tracking, influencer mapping, and PDF/CSV reports. The Service is offered to brands, political campaigns, corporate clients, and consultancy partners.

2. Eligibility & account

• You must be at least 18 years old and authorised to bind your organisation.
• You must provide accurate registration information and keep it current.
• You are responsible for safeguarding your credentials. Notify us immediately of any unauthorised use.
• You may not share a single account between multiple users; we offer multi-user access on request.

3. Acceptable use

You agree not to:

• Use the Service to violate any law, regulation, or third-party right
• Attempt to access or scrape non-public content from any platform
• Use the Service to harass, dox, surveil, or threaten any individual
• Resell, sublicense, or repackage Service data without our written consent
• Reverse-engineer, decompile, or attempt to derive source code
• Bypass rate limits, fetch frequency caps, or other technical safeguards
• Upload malicious code or interfere with the Service’s operation
• Use the Service to monitor or analyse minors
• Use the Service for credit-scoring, employment screening, insurance underwriting, housing decisions, or any other use that would create legal or material effects on individuals based on inferred attributes

4. Connected platforms & third-party terms

When you connect a Facebook Page, Instagram Business account, X account, or Threads profile, you grant Credtech permission to access the platform on your behalf using the credentials you authorise. Your use of platform data is also subject to:

• Meta Platform Terms and the relevant Meta product policies
• X Developer Agreement & Policy
• Any other applicable platform terms in force from time to time

You represent that you have the right to connect each platform you authorise and to use the data you receive through the Service.

5. AI processing

The Service uses third-party large-language models (currently OpenAI GPT-4o-mini) to classify content. AI outputs are probabilistic and may be inaccurate. You must not treat AI classifications as conclusive evidence of fact, intent, or sentiment of any individual. You are responsible for human review before taking any action based on AI output.

6. Customer data & ownership

• You retain all rights to data you upload (keywords, briefs, configuration).
• Public posts ingested via APIs remain owned by their respective publishers and platforms; we hold them under the licence the platform grants.
• You grant Credtech a non-exclusive, worldwide licence to process your configuration data and connected-platform data solely to provide the Service.
• Aggregated, de-identified analytics may be used by Credtech to improve the Service.

7. Fees & billing

Fees are stated in the order form or pricing page applicable to your subscription. All fees are exclusive of GST and other taxes. Credtech may revise pricing on 30 days’ notice for renewals. Late payments accrue interest at 1.5% per month or the legal maximum, whichever is lower.

8. Term, suspension & termination

• These Terms remain in force while you use the Service.
• Either party may terminate for material breach with 14 days’ written notice if not cured.
• Credtech may suspend the Service immediately for security incidents, non-payment, or violation of platform terms.
• On termination, you may export your data within 30 days; thereafter we will delete it consistent with the retention schedule in the Privacy Policy.

9. Confidentiality

Each party will protect the other’s confidential information with the same care it uses for its own (and at minimum reasonable care). Confidential information may be shared with employees, contractors, and advisors who need it and are under written confidentiality obligations.

10. Warranties & disclaimers

The Service is provided “AS IS” and “AS AVAILABLE”. We disclaim all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. Sentiment classifications, virality predictions, and other AI outputs are advisory and not guaranteed.

11. Indemnity

You will indemnify Credtech against any third-party claim arising from (a) your violation of these Terms, (b) your breach of any platform terms, (c) your use of the Service in a manner that infringes a third-party right, or (d) decisions you take based on Service output.

12. Limitation of liability

To the maximum extent permitted by law, Credtech’s aggregate liability under these Terms is limited to the fees you paid in the 12 months preceding the claim. Neither party is liable for indirect, incidental, consequential, or special damages, lost profits, or lost goodwill.

13. Governing law & disputes

These Terms are governed by the laws of India. Disputes shall be resolved by binding arbitration in New Delhi under the Arbitration and Conciliation Act, 1996, before a sole arbitrator. Each party retains the right to seek injunctive relief in a court of competent jurisdiction.

14. Modifications

We may amend these Terms with at least 14 days’ notice to your registered email or via in-app notice. Continued use of the Service after the effective date constitutes acceptance.
